Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the HomeLab Everywhere ("HLE") service, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not create an account or use the service. We reserve the right to modify these terms at any time; your continued use of the service after changes are posted constitutes acceptance of the updated terms.

2. Eligibility

You must be at least 18 years of age to create an account or use HLE. By using the service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms of Service. If you are using HLE on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

3. Service Description

HLE is a managed tunneling relay service that securely exposes your homelab services to the internet with built-in Single Sign-On (SSO) authentication. HLE acts as a relay between your locally-running services and end users, providing encrypted HTTP and WebSocket tunneling. The service is provided "as is" and includes:

  • Secure tunneling of HTTP and WebSocket services
  • SSO authentication gates (Google, GitHub, and native email/password)
  • Per-tunnel access control and email allow-lists
  • Web dashboard for tunnel and API key management

HLE is a relay service only. We do not host, control, or take responsibility for the services, applications, or content you choose to expose through your tunnels.

4. User Accounts

To use HLE, you must create an account and obtain an API key. You agree to:

  • Provide accurate and truthful account information
  • Maintain the confidentiality of your API keys and account credentials
  • Be responsible for all activity that occurs under your account
  • Notify us immediately of any unauthorized access or use of your account
  • Not share, transfer, or resell API keys or account access

You may manage your API keys at any time through your account dashboard. Each API key is personal and non-transferable.

5. Acceptable Use

You agree not to use HLE for any unlawful, harmful, or inappropriate purposes, including but not limited to:

  • Exposing services that distribute malware, exploit kits, or illegal content
  • Distributing, storing, or making available child sexual abuse material (CSAM) in any form — violations will be reported immediately to the relevant authorities
  • Disseminating terrorist content as defined by the EU Terrorist Content Online Regulation (EU 2021/784) or equivalent applicable law
  • Launching attacks, denial-of-service (DoS) attacks, or other malicious activities
  • Phishing, fraud, or other deceptive activities
  • Copyright infringement or unauthorized distribution of protected content
  • Violating privacy laws or compromising the personal data of others
  • Bypassing authentication, access controls, or security mechanisms
  • Abusing our infrastructure to impact service availability for other users
  • Mining cryptocurrency or performing intensive computational workloads unrelated to tunneling
  • Evading or facilitating the evasion of economic sanctions, export controls, or trade restrictions imposed by the European Union, the United States, the United Kingdom, or any other applicable jurisdiction

We reserve the right to immediately disable tunnels and terminate accounts that violate these terms, without prior notice or liability. We may retain logs and report abuse to relevant authorities where required or permitted by law. Accounts found to be repeat offenders will be permanently terminated.

6. Tunnel Content and User Services

HLE is a relay — we do not originate, review, control, or take responsibility for the content, applications, or services you expose through your tunnels. You acknowledge and agree that:

  • Sole responsibility: All content, data, and services transmitted through your tunnels are your sole responsibility. HLE shall not be liable in any way for any content or services made available via your tunnels.
  • No inspection or monitoring obligation: HLE does not access, inspect, or store the content of traffic passing through your tunnels. We collect only connection metadata (IP addresses, timestamps, bytes transferred) for billing and abuse prevention purposes. HLE has no obligation to monitor the content, data, or services transmitted through user tunnels, and assumes no liability for failing to detect or prevent any user's unlawful or harmful activity.
  • Your end users: You are responsible for the experience, privacy, and security of any person who accesses your services through HLE. You must have any required legal basis to process their personal data.
  • Sensitive information: You must not use HLE to relay services that handle highly sensitive personal data (such as medical records, financial data, or government identifiers) without implementing appropriate additional security measures on your own infrastructure. HLE does not provide compliance with HIPAA, PCI-DSS, or equivalent standards.
  • Third-party rights: You warrant that exposing your services via HLE does not violate any applicable law or any third party's rights.

7. Copyright and Intellectual Property Claims

HLE respects intellectual property rights and expects its users to do the same. If you believe that content accessible through an HLE tunnel infringes your copyright or other intellectual property rights, you may submit a notice to our designated agent:

  • By email: dmca@hle.world

Your notice must include:

  • Identification of the copyrighted work or intellectual property you claim has been infringed
  • Identification of the material that is claimed to be infringing, including the HLE tunnel URL or subdomain where it is accessible
  • Your contact information (name, address, email, telephone number)
  • A statement that you have a good-faith belief that the use of the material is not authorised by the rights owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or authorised to act on their behalf
  • Your physical or electronic signature

Upon receipt of a valid notice, we will act promptly to disable the relevant tunnel or account. We will make reasonable efforts to notify the affected user so they may submit a counter-notice if they believe the takedown was made in error.

Repeat infringers: In accordance with applicable law, HLE will terminate the accounts of users who are found to be repeat infringers.

8. Indemnification

You agree to defend, indemnify, and hold harmless HLE, its operators, affiliates, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the HLE service
  • Any content, applications, or services you expose through your tunnels
  • Your violation of these Terms of Service or any applicable law or regulation
  • Your violation of any rights of a third party, including privacy rights, intellectual property rights, or data protection rights
  • Any claim by a user of your exposed services arising from the nature, content, or availability of those services

This indemnification obligation survives termination of your account and these Terms of Service.

9. Service Availability

HLE is provided on a best-effort basis. We do not guarantee uptime or service level agreements (SLAs). The service may be unavailable due to:

  • Scheduled or emergency maintenance
  • Infrastructure failures or outages
  • Network issues beyond our control
  • Security incidents or abuse mitigation
  • Capacity constraints or resource limitations

You should not rely on HLE for mission-critical, life-safety, or legally-regulated services. Without limiting the foregoing, HLE must not be used for or in connection with high-risk applications including but not limited to: medical devices or systems, nuclear facilities, air traffic control, weapons systems, emergency services, or any application where service failure could lead to death, personal injury, or severe environmental damage.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • HLE is provided "as is" and "as available" without warranties of any kind, express or implied
  • We disclaim all warranties, including fitness for a particular purpose, merchantability, and non-infringement
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including data loss, business interruption, or lost profits, arising from your use or inability to use the service
  • To the maximum extent permitted by applicable law, our total aggregate liability to you for any and all claims arising from or relating to these terms or the service shall not exceed the total amounts you have actually paid to HLE in the 6 months immediately preceding the claim. If you are using the service on a free tier, our total aggregate liability is €0
  • We are not responsible for the security, integrity, availability, or compliance of your local services or the content you choose to expose
  • We make no representation that the service is appropriate or available for use in all jurisdictions. You are responsible for compliance with local laws if you choose to access HLE from a jurisdiction where its use may be restricted

11. Your Responsibilities

You are responsible for:

  • Securing your local services, keeping them patched and up to date
  • Implementing appropriate access controls on your exposed services, beyond those provided by HLE
  • Complying with all applicable laws and regulations in your jurisdiction, including data protection laws
  • Obtaining all necessary consents and legal bases to process personal data of your end users
  • Informing your end users about how their data is processed when they access your services through HLE
  • Backing up all critical data — HLE does not provide data backup

12. Sanctions and Export Controls

You represent and warrant that:

  • You are not located in, a national or resident of, or otherwise subject to the jurisdiction of any country or territory that is the target of comprehensive sanctions by the European Union, the United States, the United Kingdom, or the United Nations
  • You are not listed on any EU, US, UK, or UN sanctions or restricted-party list, including the EU Consolidated Financial Sanctions List, the US Specially Designated Nationals (SDN) List, or the UK Sanctions List
  • You will not use HLE to relay traffic to or from any sanctioned person, entity, or jurisdiction
  • You will comply with all applicable export control laws and regulations in your use of HLE

HLE reserves the right to immediately suspend or terminate accounts if we have reasonable grounds to believe this section has been violated.

13. Intellectual Property

The HLE service, including its software, branding, documentation, website, and all associated intellectual property, is owned by HLE and its licensors. Nothing in these Terms grants you any right, title, or interest in HLE's intellectual property except for the limited right to use the service in accordance with these terms.

You may not copy, modify, distribute, reverse-engineer, decompile, or create derivative works of the HLE service or any part thereof, except as expressly permitted by applicable law.

14. Data Protection and GDPR

HLE collects and processes your account data as described in our Privacy Policy. In the context of GDPR and equivalent data protection laws:

  • HLE as processor: For connection metadata we collect to operate the service (IP addresses, timestamps, bandwidth usage), HLE acts as a data processor on your behalf.
  • You as controller: For any personal data of your end users that flows through your tunnels, you are the data controller. You are responsible for having a valid legal basis under GDPR (or applicable law) for processing that data, providing your users with appropriate privacy notices, and responding to any data subject rights requests.
  • No data in tunnel payloads: HLE does not access or store the content of traffic flowing through tunnels. We cannot assist with data subject requests regarding information contained within your services.
  • International transfers: By using HLE, you acknowledge that your connection metadata may be processed in countries outside your home jurisdiction. We apply appropriate safeguards in line with applicable law.

15. Termination and Suspension

Suspension: We may temporarily suspend your account or individual tunnels, with or without notice, if we reasonably believe you are in violation of these Terms, if your account is being used in a manner that could cause harm to our infrastructure or other users, or if required by law. During suspension, your account data is preserved but all active tunnels are disabled. We will make reasonable efforts to notify you of the reason for suspension and any steps you may take to resolve it.

Termination by HLE: We may permanently terminate your account immediately and without prior notice for serious or repeated violations of these Terms, including but not limited to violations of the Acceptable Use policy (Section 5), Sanctions and Export Controls (Section 12), or failure to respond to a suspension notice within 30 days.

Termination by you: You may terminate your account at any time through your dashboard or by contacting us at legal@hle.world.

Effect of termination: Upon termination (by either party), all active tunnels are immediately closed and all API keys are revoked. You will lose access to your account and dashboard. We may retain logs and account metadata for a reasonable period as required by law or for legitimate business purposes (such as fraud prevention and dispute resolution).

Survival: Sections 6 (Tunnel Content), 7 (Copyright), 8 (Indemnification), 10 (Limitation of Liability), 12 (Sanctions), 14 (GDPR), and 20 (General Provisions) survive termination.

16. Fees and Refunds

HLE may offer free and paid subscription tiers. Paid subscriptions are billed in advance on a recurring basis through our payment processor, Stripe.

  • No refunds for termination for cause: If your account is terminated by HLE due to a violation of these Terms, you are not entitled to any refund of pre-paid fees.
  • Voluntary cancellation: If you cancel your paid subscription, you will retain access to paid features until the end of the current billing period. No pro-rata refunds are issued for unused time within a billing period.
  • Price changes: We may change our pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing period following notice of the change.

17. Force Majeure

HLE shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions or regulations, labour disputes, power or telecommunications failures, internet service provider failures, denial-of-service attacks, or any other force majeure event. During such events, HLE's obligations are suspended for the duration of the event.

18. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands and, where applicable, the law of the European Union (including the GDPR).

Informal resolution: Before initiating any formal proceedings, you agree to first contact us at legal@hle.world and attempt to resolve the dispute informally for a period of at least 30 days.

Jurisdiction: If informal resolution fails, you agree to submit to the non-exclusive jurisdiction of the courts of the Netherlands for the resolution of any dispute arising from these terms, without prejudice to your rights as a consumer under the mandatory laws of your country of residence.

Statute of limitations: Any claim or cause of action arising out of or related to these Terms or the service must be filed within one (1) year after such claim arose, or the claim is permanently barred. This limitation applies to the fullest extent permitted by applicable law.

Class action waiver: To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against HLE.

19. Changes to Terms

We may update these Terms of Service at any time. When we make material changes, we will notify you via the email address on your account or by posting a notice on our website at least 14 days before the changes take effect. Your continued use of HLE after the effective date of changes constitutes acceptance of the updated terms. If you do not agree with the changes, you must stop using the service and terminate your account before the effective date.

20. General Provisions

  • Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and HLE regarding the service and supersede all prior agreements, understandings, and communications.
  • Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
  • Waiver: The failure of HLE to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by HLE to be effective.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. HLE may assign these Terms, in whole or in part, to any successor or affiliate without your consent, provided that such assignment does not reduce your rights under these Terms.
  • Electronic communications: By using HLE, you consent to receiving electronic communications from us (via email or notices posted on the service) and agree that such communications satisfy any legal requirement for written notice.
  • No third-party beneficiaries: These Terms do not create any rights for any third party, and no third party may enforce any provision of these Terms.
  • Headings: Section headings are for convenience only and have no legal effect.
